ASAP Digital, MB (hereinafter referred to as the „Company“) values your trust and is committed to ensure proper protection of your personal data. We respect your privacy and pledge to process and protect your personal data in a fair and lawful way in accordance with the applicable legal requirements of the European Union (General Data Protection Regulation 2016/679) (hereinafter referred to as the „GDPR“).

This Privacy policy explains how we collect and process the personal data about people who use our services. This Privacy policy provides information about the scope of processing personal data, the purposes, sources, recipients, and other important aspects of personal data processing.

In this Privacy policy, we describe what personal data we collect and process about people who use our services, clients and their representatives, visitors of this website, people that consented to receive direct marketing messages, job applicants for the vacant job position.

This Privacy policy applies to our website and our mobile apps for iPhone, Windows and Android mobile devices (collectively, “our Service”).

After you set up your account, we collect information in connection with your use of the Service, including your work schedule, your availability, your time records, your photo, your messages to others on the Service and comments you make on the Service forums or blogposts.
     

  • Information we receive from third parties. From time to time, we may receive information about you from third parties, such as identity verification, payroll vendors and other information. We may also collect information about you that is publicly available.
     

We use this information to operate, maintain, and provide to you the features and functionality of the Service, as well as to communicate directly with you, permit you to communicate with others on the Service. We may send you communications that contain information about our products or Service, or information about third parties’ products or services we think you may enjoy. We may also send you Service-related communications (e.g., messages and schedules, change or updates to features of the Service, technical and security notices). 

 

How we use cookies and other tracking technology to collect information

For example, some of your information may be shared with your employer and with other employees of the same employer in order to facilitate scheduling, timekeeping and communication. For example, we provide reporting tools to allow an employer to evaluate the efficiency of its workforce, and its employees’ responsiveness and availability;
     

  • Third party vendors, consultants and other service providers that perform services on our behalf, in order to carry out their work for us.
     

  • Other parties in connection with any company transaction, such as a merger, sale of all or a portion of company assets or shares, reorganization, financing, change of control or acquisition of all or a portion of our business by another company or third party or in the event of bankruptcy or related or similar proceedings; 
     

  • Third parties as required to (i) satisfy any applicable law, regulation, subpoena/court order, legal process or other government request, (ii) enforce our Terms of Service, including the investigation of potential violations thereof, (iii) investigate and defend ourselves against any third party claims or allegations, (iv) protect against harm to the rights, property or safety of When I Work, its users or the public as required or permitted by law and (v) detect, prevent or otherwise address criminal (including fraud or stalking), security or technical issues.

 

We may also share information with others in an aggregated and anonymous form that does not reasonably identify you directly as an individual.

 

Your Choices Regarding Your Information

 

If you use the Service as an employee, certain elements of your information will be automatically shared with your employer, depending on how your employer has configured the company account and user permissions on the Service.
 

From time to time, the Service will send communications about news and updates, advice and analytics relating to your use of the Service. The Service also facilitates communication between users by email, text message and in-app notifications.
 

When an employer invites an employee to register with the Service, we will send that employee a message using the contact information provided by the employer. The employer must certify that it has the employee’s consent for ASAP Digital to contact the employee on the employer’s behalf using that method of communication.


Customer support


We value your feedback and we want to understand what we can do to improve our services. Therefore, you can contact us in order to receive assistance on your question or concern as well as any time that you are seeking to implement your rights.


If you contact us, we will process your personal data by collecting your contact details through the source you chose to contact us (via e-mail, post or any other way).


All personal data will be processed on the basis of your consent which is expressed by your actions by sending us a question, concern or request.


Your personal data will be stored for 1 year after certain question, concern or request was sent to us. In some individual cases, in accordance with the applicable legal requirements, your personal data might be stored longer.


Direct marketing


From time to time, we may send promotional messages. Note that you are not permitted to unsubscribe or opt-out of non-promotional messages regarding your account, such as account verification, change or updates to features of the Service, or technical and security notices. You have the right to refuse direct marketing at any time by contacting us via e-mail on info@asapdigital.com


Data Retention


We will retain your information for as long as your account is active or as needed to for our internal purposes. When you deactivate your account, including if you are removed from an employer’s company account, we will remove your information from view by others on the Service but we may retain your account information internally so that you can access your account history through an individual account. You may request to delete your account information by contacting us at info@asapdigital.com. However, please be aware that we will not be able to delete any content you have shared with others on the Service. For example, your employer will have a record of your schedule when you were employed, and will retain the data the employer provided to us about you.


Processing personal data for recruiting purposes


You can send us your data in order to join our Company. Your personal data you present for the purpose of recruiting for the vacant job position in our Company will be processed based on your consent, expressed by submitting your personal data.


We collect and process your CVs and/or motivation letters, and/or other information submitted by you at the time of participation in the selection for the purpose of recruitment and on the basis of your consent which you give to us or to the recruitment company by sending your curriculum vitae.


If you do not submit your curriculum vitae and/or motivation letter, we will not be able to assess your suitability for the offered position.

Please comply with personal information protection requirements and do not send us excessive information. Please observe at least the following minimum requirements for the protection of your personal information by sending personal data to us: do not indicate excessive or unnecessary personal data either in the subject line of the letter or query, or in the attached CV, in motivational letters, in other files: personal identification code, health or other special personal data, financial data, bank account number, family member data, car license plate number, etc.


All personal data will be stored until ongoing recruitment process is finished. Please note that on basis of your consent we could store and use personal data you sent for the purposes of later recruitment for up to 1 year. Once you have given such a consent, you are entitled to withdraw it at any time, without prejudice to lawfulness of personal data processing based on such consent until the withdrawal of the consent. If you exercise this right, we will immediately take action to destroy your personal data.


Please note that in order to evaluate your candidacy, we may contact the former employers you have indicated for their recommendations and may ask them about your qualifications, professional skills and business qualities. We can request such information from your current employer only if we have your separate consent for this.


Deleting or Anonymizing Your Content.


If you are under 18 years of age, you may request to delete or anonymize user content that you posted to the Service such that your personal information will not be identifiable publicly on our Service by contacting us at info@asapdigital.com. While we will use all commercially reasonable efforts to delete or anonymize your user content upon request, please be aware that due to the nature of our Service, you may not be able to completely remove all of your personally identifiable user content if, for example, that content has been stored, republished, or reposted by another user or a third party. We may also maintain your information in identifiable form for our internal use, even if your personal data is no longer visible to the public on our Service.


Security and Storage of Information


ASAP Digital cares about the security of your information and employs physical, administrative, and technological safeguards designed to preserve the integrity and security of all information we collect and that we share with our service providers. However, no security system is impenetrable and we cannot guarantee the security of our systems 100%. In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations. If you are an employee whose information is associated with a Company account on our Service, we will notify the employer or company user of a breach of security which requires legal notification, and your employer shall be responsible for informing you of the incident.


Persons Under the Age of 13


The Service and its content are not directed at children under the age of 13. In the event that we learn that we have collected personal information from a child under age 13 without parental consent, we will delete that information as quickly as possible. If you believe that we might have any information collected from a child under 13, please contact us at info@asapdigital.com..

  • The right to be informed. As a data controller, we are obliged to provide clear and transparent information about our data processing activities. This is provided by this Privacy policy.
     

  • The right of access. We want you to fully understand how we use your personal data and not to experience any inconvenience because of that. You can contact us at any time and ask if we process any of your personal data. If we store or use your personal data in any way, you have the right to access them. We will provide access to the personal data we hold about you as well as the following information: the purposes of the processing, the categories of personal data concerned, the recipients to whom the personal data has been disclosed, the retention period or envisioned retention period for that personal data, when personal data has been collected from a third party, the source of the personal data.
     

  • The right to rectification. When you think we process inaccurate or incomplete personal information about you, you may exercise your right to correct or complete certain personal data. This may be used with the right to restrict processing to make sure that incorrect/incomplete personal data is not processed until it is corrected.
     

  • The right to restrict processing. We ensure that as soon as we receive your complaint, we will contact you within a reasonable period and inform you about the complaint handling process, and them about its result.
